Protection against forced marriage

MSPs have backed a new law to protect people being forced into marriage against their will. The Forced Marriage etc (Protection & Jurisdiction)(Scotland) Act 2011 will make it a criminal offence to breach new laws leading to a two year prison sentence, a fine of up to £10,000, or both.

 

Scottish courts will have the power to issue Forced Marriage Protection Orders, to ensure people are taken to a place of safety or help those in danger of being taken abroad for marriage.

 

Existing powers to annul a forced marriage will be clarified to streamline the process.

 

Housing and Communities Minister Alex Neil said: "Forced marriage is slavery and has no place in a modern Scotland. It is unacceptable to have your life choices taken away from you, as well as your right to decide who, or if, to marry. This is compounded by suffering, in many cases, a spectrum of abuse including threats, blackmail and violence. This legislation will provide the type of protection that vulnerable victims of forced marriage require and deserve."
