A Court of Session ruling in a divorce settlement case has created a level of controversy in legal circles.
According to the Scotsman, the 47-year-old man was awarded legal aid to defend his ex-wife's settlement claim of £10 million, despite being a former millionaire business tycoon. His ex-wife was eventually awarded £1.6 million as a settlement figure.
Politicians have criticised the award of legal aid, although his financial eligibility was apparently investigated thoroughly before the Scottish Legal Aid Board approved his entitlement.
Unusually, around half of the ex-wife's settlement is to come from a trust fund her ex-husband had set up in respect of children he had fathered with another woman, says the Scotsman. Money secured in such trusts are normally thought to be protected under Scots Law.
